Who we are and how we would like to do business with you.
We are La Belle Vie Adventures Pty Ltd, a private company incorporated under the laws of South Africa with registration number (2023/902101/07) and its registered office at (367 Main Avenue, 20 Vilamoura, Randburg, Gauteng, 2194)
When you book an experience or travel adventure through us, these booking terms are your agreement with La Belle Vie Adventures.
For each group activity or travel experience, the itinerary will indicate what is included in the package. This may include flights, airports transfer to and from the hotel and certain activities, meals, or other forms of transportation. In this capacity we act as agent. Therefore, when you make a booking with us, you acknowledge and agree that we act as agent for the third-party service provider, the party responsible for providing the relevant item on the itinerary.
These third-party service providers all have their own terms and conditions (the third-party service provider agreement). When you accept our booking terms, you also accept and agree to be bound by the applicable third-party service provider agreement.
The relevant third-party service providers are indicated on your quote or travel documents and their third-party service provider agreement(s) applicable to your booking will be available on their websites or can be obtained by contacting them or us.
We rely on the authority of the person making the booking to act on behalf of any other traveller(s) forming part of the quotation, who hereby confirms that he/she is authorized to do so, and that he/she binds all such travellers to the booking terms and third-party service provider agreement(s).
Bookings and how to make them
All prices for bookings advertised by us are subject to availability and can be withdrawn or varied without notice.
Advertised prices may be limited to travel within specified dates.
Advertised prices are quoted on shared accommodation. Should you want alternative forms of accommodation, prices are subject to change. Solo travellers may be subject to single supplement payments.
All prices are quoted in South African Rand. Upon request, a quotation will be sent to your preferred email address. All quotes are valid for 5 calendar days before being subject to change.
If a quotation contains an obvious error, we are not bound by it and will be entitled to correct the error. Should we misquote you we are under no obligation to honour a misquote and may correct the pricing prior to payment.
Bookings require the payment of a deposit per person as well as final payment to be received on the respective dates both of which are specified in the quotation. Deposits must receive within 5 days from receiving the quotation to secure the booking and the quoted price.
Bookings are not considered confirmed until receipt of final payment.
The experience(s) provided for in the itinerary cannot be guaranteed by us because all quotations are subject to the availability of third-party service providers. Any of the planned experience(s) may be subject to change due to for example the weather, conditions becoming unsafe or any other unforeseeable reason that only becomes apparent after the booking is made. Our policy is to provide an alternative itinerary for such instances so that the booking may continue.
Therefore, if you are only making the booking with us to attend a particular event mentioned in the itinerary, you need to advise us of this fact so that we can best assist you. However, this does not change our policy around unforeseeable conditions preventing the event from proceeding and us offering an alternative. We simply cannot predict the future and cannot refund you after a certain point in time.
Our bookings are generally subject to the experience taking place during a specified date. In certain instances, we may consider and agree to changing the dates of a booking on request, however you will be liable for date change penalties.
How and when we would like to get paid
We will not proceed with any booking until the payment of a deposit per person reflects in our account.
The price quoted for a booking is only considered firm if a deposit for that booking reflects in our account within 5 days from receipt of the quotation and the final payment reflects in our account on the date stipulated on the quotation. In all other instances the price may be subject to change.
Where the price is subject to exchange rate fluctuations, prices are subject to change until full payment reflects in our account. If your booking is subject to a foreign exchange rate, the exchange rate on the day of the quotation provided to you will apply. Should the exchange rate have increased by the time that full payment of your booking reflects our account, such increase will be for your account and payable in addition to the total price quoted. If the exchange rate has decreased by the time we receive payment, the difference, if any, will be reimbursed to you.
Certain airfares and services are booked at rates that may require payment in full within 5 colander days’ of receiving the quotation. Cancellations and refunds for these bookings may be limited by the third-party service provider and will be indicated to you as far as possible.
Your quotation also includes our service fees for booking and servicing your travel arrangements and the itinerary. Service fees are non-refundable in case of a cancellation after the date of full payment as specified on the quotation. Service fees vary and are indicated on your quotation.
Methods of payment we accept:

EFT
For Electronic fund transfer (EFT) you will be provided with account details on the quotation. You must notify the consultant of your payment once it has been made.
You will be liable for any additional taxes levied by the relevant city visited. For example, any additional taxes charged to restaurant bills when paying by card.
When will be refund you
All our refunds are subject to the cancellation policy of the relevant third-party service provider.
Subject to the above, we will always refund you 100% of your deposit or payment in full in instances of death, or hospitalisation occurring before departure. This is subject to you providing the necessary proof of such an instance occurring. In other words, a death certificate in instances of death and a doctors notification indicating that you have been hospitalised.
In all other instances deposits are not refundable.
Should you cancel your booking with us 80 days prior to the booked departure date we will refund you all amounts paid over and above the deposit (which is not refundable). In these cases, we will allow you to transfer your deposit to another booking with us that must take place within a 12-month period from the date of cancellation.
Should you cancel your booking between 80 and 45 days prior to the booked departure date we will refund you 50% of all amounts paid over and above the deposit (which is not refundable).
Should you cancel your booking between the 45 and 30 days prior to the booked departure date we will refund you 25% of all amounts paid over and above the deposit (which is not refundable)
Any cancellations 30 days prior to the booked departure date are not entitled to a refund.
Refunds, if applicable, will only be made to the person named on the booking payment receipt, unless otherwise agreed upon in writing by all travellers listed on a booking.
Our liability in your adventure
By offering travel packages to a particular destination, we do not in any way represent or warrant that travel to such destination is advisable or without risk. You agree that we will not be liable in any way for any damage, loss, death, or injury that may result from your travel to any of our destinations.
To be clear we will not be liable for any loss, costs, damage, injury, illness, harm, or death which you may suffer or incur because of any act or omission on the part of or the failure of the third-party service provider to fulfil its obligations to you, whether in relation to travel services, accommodation or in any other manner.
Traveling with the right documents
Travel documents include airline tickets, vouchers, or any other document (whether in electronic form or otherwise) used to confirm a booking with a third-party service provider.
Airline tickets must be issued in the name of the passport/identity holder. It is your responsibility to ensure that your names (as per identity documentation and/or passports), identity and/or passport numbers, travel dates, times, departure, destination, and routings as reflected on your travel documents, are correct.
An incorrect name on a booking may result in an inability to travel on that booking and the booking being cancelled. Please review your travel documentation carefully and advise us immediately of any errors in names, dates, or timings.
Your travel documents inclusive of itineraries will be electronically shared with you prior to travel. It is important that you observe all airline check-in times and requirements. If for any reason you do not receive your travel documentation, please let us know so that we can supply this to you well in advance of your departure.
Identification is required for all passengers travelling domestically, including infants. A South African identity document, Smart ID card or driver’s licence is required for check in. Infants and minors are required to produce an unabridged birth certificate or equivalent document at the time of check in.
A valid passport is required for all passengers travelling internationally. Passports must be valid for at least six months after the date of intended return and must have a minimum of two blank pages. It is your responsibility to ensure compliance with the immigration law of all countries visited on your itinerary. It is your responsibility to ensure that you have all the required supporting documentation or visas.
More than one visa may be required, and it is important to check that you hold the required visas for your travel, not only for the final destination, but also for all transits, stopovers, port entries, border crossings and ocean border crossings.
We will not be liable for any claims or costs for which you are liable, associated with travel bans, travel restrictions or denial to board a flight because of insufficient supporting documentation, internal security matters, customs or home affairs related matters.
It is your responsibility to check health requirements and recommended precautions relevant to your travel, including but not limited to ensuring that all necessary vaccination documentation is presented. We recommend that you consult your local doctor, travel medical service or specialist vaccination clinic before commencing travel. Most vaccinations need to be administered prior to travel to be considered effective.
Travel insurance
We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. It is your responsibility to ensure that you have valid travel insurance, and we will not be responsible or liable if you fail to take adequate insurance cover.
Social media

You agree that your use of our social media pages which include but are not limited to Facebook pages, Instagram, Twitter, Tik Tok, Telegram accounts, will not be defamatory, unlawful, obscene, offensive, hateful, abusive, inflammatory, threatening, invasive of anyone’s privacy, or otherwise contain objectionable comments and/or content.
We do not tolerate any form of discrimination on grounds of race, sex, religion, nationality, disability, religion or belief, sexual orientation, being a transsexual person, or age. We reserve the right to remove any comment, thread, or content without prior warning to you. We also reserve the right to bring legal proceedings against any individual for a breach of these rules or law generally or take such other action as we reasonably deem appropriate.
You also agree that when it comes to us taking any pictures, we own and have the exclusive right to claim copyright ownership of those pictures taken by us or any of our representatives whilst on an experience with us. This includes the right to reproduce, distribute and publicly display.

We have the exclusive right to use, license, sublicense, sell, or otherwise exploit the pictures in any manner and for any purpose, including but not limited to, commercial, promotional, advertising, editorial, and artistic purposes.
Any individuals who participate in the creation of the pictures waive all rights to ownership, copyright, or other intellectual property rights in the pictures, and acknowledge that we are the sole and exclusive owner thereof.
We have the right to modify, alter, edit, or enhance the pictures in any manner, without any obligation to seek approval from any third parties involved in the creation of the pictures.

Any individuals participating in the creation of the pictures shall indemnify and hold us harmless against any claims, liabilities, damages, expenses, or losses arising from any third-party claims asserting ownership or rights to the pictures.

We have the right to assign, transfer, or license its ownership rights in the pictures to any third party, without the need for further consent from the individuals involved in the creation of the pictures.

Privacy Policy
We are committed to protecting your personal information and will process your personal information in accordance with our Privacy Policy, available here.
By providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information, and you consent to us collecting, using, disclosing and otherwise processing your personal information as detailed in our Privacy Policy.
We and our third-party service providers may disclose your personal information, and you hereby consent to such disclosure as required by the Protection of Personal Information Act No.4 of 2014, to third parties that are directly connected with facilitating your travel arrangements and bookings and the provision of travel service and products. For example, we may disclose your personal information to airlines, hotels, car rental companies and other service providers in facilitating your travel arrangements.
Therefore, we may also disclose your personal information to service providers who perform services for us within and outside the Republic of South Africa.
Where we disclose your personal information to a third-party overseas recipient, you agree that the recipient may be located in a country with laws that do not protect personal information as stringently as those of the Republic of South Africa. You acknowledge that we deal with thousands of travel service providers around the world (some of which are very small operations or are located in countries with laws, and/or in regions with technology, which may not be advanced as those existing in the Republic of South Africa). Therefore, where your requested travel arrangements require that your personal information be sent to an overseas recipient you agree that this is at your risk, and we will not be liable or accountable for how those recipients handle your personal information.
General
The law of South Africa applies to this agreement and any dispute between the parties.
This Agreement constitutes the sole record of the agreement between the parties about the subject matter. No party shall be bound by any express or implied term, representation, warranty, promise or the like not recorded herein.
No amendment, cancellation or waiver of any term or right referred to in these booking terms shall be valid or binding unless reduced to writing and signed by both you and a duly authorized representative.
No relaxation or indulgence which we may grant you shall constitute a waiver of our rights and shall not preclude us from exercising any rights which may have arisen in the past or which might arise in future.
All intellectual property is our sole and exclusive property.
The parties choose their address in the Booking Form as its legal address for the purposes of giving any notice or the serving of any process.
If any of these terms are held to be unlawful or unenforceable, they shall be deemed separate and divisible from and shall in no way affect or impair the validity or enforceability of, the remaining provisions
Acceptance
You accept that these terms are applicable to every booking made with us.
